Terms of Service

1. Agreement to terms

By accessing or using Sayseal ("the Service"), operated at sayseal.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Sayseal is operated by Sayseal ("we," "us," or "our").

2. Description of the Service

Sayseal is a proposal generation tool that allows freelancers, agencies, and businesses to create professional proposals from voice recordings or text input. The Service includes proposal creation, branding customization, delivery, and tracking features.

3. Accounts

To use certain features you must create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. We reserve the right to suspend or terminate accounts that violate these terms.

4. Plans and pricing

Sayseal offers the following tiers:

• Trial: 7-day free trial with full access. No branding or restrictions during trial period.
• Solopreneur: Increased proposal limits, full branding customization, PDF export, multi-channel delivery, and client acceptance. Billed monthly via Stripe.
• Studio: Unlimited proposals with all features from Solopreneur. Billed monthly via Stripe.

We reserve the right to change pricing with 30 days' notice. Price changes will not apply to the current billing period.

5. Billing and cancellation

Paid subscriptions are billed monthly in advance through Stripe. You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until then. We do not offer refunds for partial billing periods.

6. Your content

You retain full ownership of all content you create through Sayseal, including proposals, text input, transcriptions, and any business information you provide. We do not claim any intellectual property rights over your content.

By using the Service, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the Service to you. This license ends when you delete your content or your account.

7. Sayseal branding

All proposals are fully branded with your business identity. No Sayseal branding is added to any proposals, including during the trial period.

8. Acceptable use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Send fraudulent, misleading, or deceptive proposals.
• Abuse, harass, or harm others through the Service.
• Attempt to gain unauthorized access to the Service or its systems.
• Use automated tools to scrape, crawl, or burden the Service.

9. Service availability

The Service is provided on an "as-is" and "as-available" basis. We strive to maintain high uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

10. Limitation of liability

To the maximum extent permitted by law, Sayseal and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, loss of revenue, lost profits, loss of business, or loss of data.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that proposals generated will be error-free or suitable for any specific purpose. You are responsible for reviewing all generated content before sending it to clients.

12. Indemnification

You agree to indemnify and hold harmless Sayseal and its operators from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may export your data before termination by contacting us. Sections regarding liability, indemnification, and intellectual property survive termination.

14. Changes to these terms

We may update these Terms of Service from time to time. If we make material changes, we will notify you by email or by posting a notice on our website at least 14 days before the changes take effect. Your continued use of the Service after changes are effective constitutes acceptance.

15. Governing law

These terms are governed by the laws of the Netherlands, without regard to conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved in the courts of the Netherlands.
